General terms and conditions of sale (GTC)

These General Terms and Conditions of Sale (GTC) govern the sales of products between the company Pilates Temple and any natural or legal person (hereinafter "the Client") placing an order on the website www.pilatestemple.com .

1. Seller's identity

2. Products

The products offered for sale are those listed on our website, subject to availability. Each product is accompanied by a detailed description. Product photographs are for illustrative purposes only and are not contractually binding.

3. Price

Prices are shown in euros including VAT. Pilates Temple reserves the right to change its prices at any time, but products will be billed based on the rates in effect at the time the order is validated.

4. Orders

The customer can place an order on the website www.pilatestemple.com by following the online ordering process.

All orders imply acceptance of the prices, product descriptions and general terms and conditions of sale in effect on the day of the order.

Once the order is validated and payment confirmed, the customer receives a confirmation email summarizing the order details. This email constitutes acceptance of the order by Pilates Temple.

Pilates Temple reserves the right to refuse or cancel any order from a customer with whom there is a prior dispute regarding payment for an order.

Products are offered subject to availability. If a product becomes unavailable after order confirmation, the customer will be notified by email as soon as possible and automatically refunded.

5. Payment

Orders are paid for online using the following payment methods:
- Bank card (Visa, Mastercard, etc.)
- PayPal

Payment is due immediately upon ordering. No order will be shipped until payment has been received.

Transactions are secured by our payment providers. Pilates Temple never has access to customers' bank details.

If the bank refuses payment, the order is automatically cancelled.

The customer guarantees that they have the necessary authorizations to use the payment method selected when validating the order.

6. Delivery

Products are shipped from Belgium, primarily via DHL. Pilates Temple offers worldwide delivery.

The estimated delivery times are as follows:
- Europe and the United Kingdom: 1 to 3 business days
- Outside Europe: 3 to 10 working days (depending on the country and customs processing)

These delivery times are estimates and may vary depending on the destination, time of year, or circumstances beyond our control. Pilates Temple cannot be held responsible for delays caused by the carrier or customs.

Shipping costs are calculated automatically during the ordering process, based on the destination, weight and volume of the package.

Free delivery is offered for purchases over a certain minimum amount, which is indicated at checkout.

The customer is responsible for the accuracy of the delivery information provided. In the event of an error resulting in reshipment, the customer will be responsible for any additional costs.

7. Right of withdrawal and return conditions

In accordance with European legislation, the customer has a period of 14 days from receipt of their order to exercise their right of withdrawal, without having to justify a reason or pay a penalty.

The customer must return the item(s) in their original condition, unused, undamaged, clean and in their original packaging, accompanied by all accessories, instruction manuals and documentation.

Returns are at the customer's expense, except in the case of a defective product or an error attributable to Pilates Temple.

Customer verification and responsibility:

Any returned product that is damaged, incomplete, used, or soiled will not be eligible for a refund or exchange. Pilates Temple reserves the right to refuse a return if the product does not meet the above conditions.

The customer is responsible for any diminished value of the product resulting from handling other than what is necessary to establish its nature, characteristics or proper functioning.

In the case of a product that is allegedly damaged:

The customer agrees to provide clear evidence (photos or videos) of the defect or damage upon receipt of the package. Otherwise, Pilates Temple reserves the right to refuse a refund, unless clear proof is provided.

If the returned product is found to be damaged by the customer, Pilates Temple will not issue a refund and reserves the right to keep or return the product at the customer's expense.

8. Guarantees and Liability

Pilates Temple is committed to delivering products that comply with current Belgian legislation and applicable standards at the time of the order.

All products sold benefit from the legal guarantee of conformity (articles 1649bis et seq. of the Belgian Civil Code) and the guarantee against hidden defects (articles 1641 to 1649 of the Civil Code), allowing the customer to return defective or non-conforming delivered products.

In the event of a lack of conformity, the customer has two years from the date of delivery to invoke the legal guarantee. However, they must notify the seller of the defect within a reasonable time after discovering it.

Warranty exclusions:

The warranty does not cover: normal wear and tear of the product, damage caused by misuse, inadequate maintenance or negligence, modifications or repairs carried out by the customer or an unauthorized third party.

Limitation of liability:

Pilates Temple cannot be held responsible for: indirect or consequential damages related to the use of the products, non-compliance with the legislation of the country in which the products are delivered (it is the customer's responsibility to check this), any loss or damage resulting from a case of force majeure (strike, natural disaster, etc.).

9. Intellectual Property

All content on the Pilates Temple website (texts, images, videos, logos, graphic elements, graphic charter, domain name, etc.) is protected by intellectual property law, and in particular by copyright and trademark law.

Any reproduction, representation, adaptation, modification, distribution or exploitation, in whole or in part, of any element of the site, without the prior written authorization of Pilates Temple, is strictly prohibited and may be subject to legal proceedings.

The products offered for sale may also be protected by intellectual property rights, particularly if they bear a logo or specific design. The customer agrees not to reproduce, copy, or exploit the products or their design for commercial or personal purposes without authorization.

10. Applicable Law

These Terms and Conditions are governed by Belgian law. In the event of a dispute, an amicable solution will be sought before any legal action is taken. Failing that, the Belgian courts shall have exclusive jurisdiction.

Collection of personal data
When browsing the Pilates Temple website, some data may be collected automatically (IP address, browser type, pages viewed, etc.), while other data is provided voluntarily by the customer (name, surname, address, email, etc.) when ordering or subscribing to the newsletter.

This data is necessary for: Order processing and deliveries; Customer relationship management; Sending promotional offers, if the customer has consented; Compliance with legal and tax obligations.

Data retention
Data is kept for: 10 years for order-related data (billing); 3 years for marketing data from the last contact with the customer; less if the customer requests deletion, unless there is a legal obligation to retain it.

Data transmission
The data collected is never sold. It may be transmitted to third-party service providers as part of the execution of the contract (e.g., payment platform, carriers), only to the extent necessary.

In the absence of an amicable agreement, the Belgian courts shall have sole jurisdiction to hear the dispute, even in the event of multiple defendants or third-party claims.

12. Amendments to the General Terms and Conditions of Sale

Pilates Temple reserves the right to modify these General Terms and Conditions of Sale at any time, in particular to adapt to legislative, regulatory or technical developments, or to its own commercial needs.

The applicable terms and conditions are those in effect on the date the order is placed by the customer.

Any changes to the Terms and Conditions will be clearly indicated on the website, and customers will be asked to review them regularly.
